1. GENERALITIES

BELEVELS S.L.,to which we will refer as Levels, is the owner of the website located at the domain name www.belevels.com.

Using the website and/or registering as a user implies acceptance of the terms and conditions described herein.

a) These General Terms and Conditions are valid for all commercial relationships between Levels and its customer, in the version in force at the time of signing the contract.

b) Different general terms and conditions of the customer will be rejected.

c) Customers according to art. 1 (a) shall be considered both consumers and entrepreneurs. A consumer is any natural person for whom the purpose of the order is not attributable to an industrial, independent or self-employed professional activity. An entrepreneur, on the other hand, is a natural or legal person or a legal partnership that places the order for industrial, independent or self-employed professional purposes.

 

 

2. FORMALIZATION OF THE CONTRACT

These Terms and Conditions of Use constitute the entire contract through which the conditions of purchase of the products made available to users by Levels on the website are regulated.

Access to the website or its use by the user, as well as the purchase of any product, necessarily implies, and without reservation, the knowledge and acceptance of these terms of use, therefore, it is recommended that the user read them carefully each time they want to purchase a product.

 

 

3. PRODUCT PURCHASE

 

3.1. How to purchase a product

To order products, the user must follow the purchase procedure established on the website, as well as read and accept these Terms and Conditions of Use. Be Levels will then send an email to the user confirming that the order has been accepted. The contract between the user and Be Levels will be finally formalized once Be Levels sends the purchase confirmation to the user. Only those products indicated in the order will be subject to the contract.

 

3.2. Product availability

All orders are subject to product availability. In the event that, once the shipping confirmation has been sent, Be Levels is unable to provide the requested product for any circumstance, it will contact the user as soon as possible to inform them of this fact. In such a case, Levels may:

 a) Offer the user, without an increase in price, a product with characteristics and specifications similar to the one initially requested, provided that these are in line with the user's needs; and/or

b) Offer the user to cancel the requested order, refunding the amount paid for it, within 15 working days.

     

    3.3. Refusal to process an order

    Levels reserves the right to withdraw any product from the website at any time and to remove or modify any material or content from it, not being liable to the user or to any third party for withdrawing any product from the website, regardless of whether said product has been sold or not.

     

    3.4. Money-back guarantee

    1. The customer has the option to return products within the first15 daysof receipt, with the right to a refund of the purchase price. The period begins after receipt of the goods.
    2. The customer is only entitled to the money-back guarantee if the products are intact, sealed, complete, and in their original packaging.Products must be returned at the customer's expense.
    3. The money-back guarantee applies to all products.

    After successful receipt of the goods by the provider within the15-dayperiod and if all the above conditions are met, the customer will be refunded the full purchase price.

     

    3.5. Product delivery

    Products will be delivered to the address indicated by the user when placing the order within approximately one to seven working days from the time they leave the Levels warehouse, depending on the destination.

    Be Levels assumes no responsibility when the product delivery cannot be made due to false, inaccurate or incomplete data provided by the user, or when delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the user or the retention of the product at customs.

    Be Levels does not guarantee that order deliveries will be made at specific and precise times. If the buyer indicates a specific delivery date or, within it, expresses a preference for a specific time slot, it will be understood that this is for guidance only.

    Delivery times are approximate, although Levels constantly strives to meet them.Saturdays, Sundays and holidays there is no order collection or delivery service, a circumstance that will affect the calculation of delivery dates.

     

    3.6. Shipping costs

    Shipping costs include transport, insurance and customs clearance at origin. If your order passes through customs, we are not responsible for any additional costs this may entail.

     

    3.7. PRICE AND PAYMENT OF PRODUCTS

    The prices applicable to each product will be those published on the website on the date the user places the order.

    a) Payment method

    The user can make payment by credit or debit cards Visa, Visa Electron, Mastercard, American Express, or by bank transfer. To minimize the risk of unauthorized access, the user's credit card data will be encrypted.

    b) Value Added Tax (VAT)

    The applicable VAT rate will be the legally current rate at any given time depending on the specific product in question.

    c) Belevels SL undertakes not to allow any transaction that is illegal, or considered by credit card brands or the acquiring bank to have the potential to damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all applicable laws to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited:

    4. DISCLAIMER OF LIABILITY

    1. a) Rights to compensation for damages caused to the customer by negligence in the use of Belevels SL products are excluded. The aforementioned disclaimer also applies in favor of the legal representatives and executive assistants of the supplier in the event that the customer makes claims against them.
    2. b) Excluded from the disclaimer of liability established in point 1 are rights to compensation for personal injury in the event of damage to life, bodily integrity and health and rights to compensation for damages caused by the use of products and damages resulting from the violation of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract; for example, the supplier must deliver the object to the customer free of material and legal defects and provide ownership thereof. Also excluded from the disclaimer of liability is the right to compensation for damages caused by intentional violation or gross negligence of the obligations of the supplier, its legal representatives or executive assistants.

     

     

    5. WEBSITE OWNERSHIP

    The website is owned by Belevels SL. All content, image and software rights available on this website belong to Belevels SL and are licensed and protected by Intellectual Property, Industrial Property laws and international treaties referring to Copyright.

    Reproduction, transmission or exploitation of the content of this website requires the explicit authorization of Belevels SL.

    The publication, manipulation, distribution or reproduction, in any medium, of any content of this website is prohibited, as is its linking to any business or company.

    Belevels SL is not responsible for the information contained in third-party websites connected by links with the website.

    Under no circumstances will Belevels SL be responsible for damages or losses of any kind arising as a consequence of or in relation to the use of the website.

    Belevels SL may claim for damages resulting from the user's breach of these Terms and Conditions or the use of the content of the Website without prior authorization.

    In the event that any provision of these general terms and conditions is invalid, this fact will not affect the validity of the other provisions.
